Some companies are now using monitoring techniques—referred to as “people analytics”—to learn as much as they can about you, from your communication patterns to what types of websites you visit to how often you use the bathroom.
What has remained is the National Labor Relation Board’s (NLRB) position that Section 7 of the National Labor Relations Act (NLRA) protects workers’ substantive rights to join together in class actions.
The NLRB has found these forced arbitration agreements interfere with workers’ right to engage in concerted activity for their mutual aid and protection, in violation of the NLRA.

With the appointment of Gorsuch, we risk losing the highest court in the land to partisan, ideologically-driven cruelty — masked as “originalist” readings of both statute and law — repeating history again.
